This Privacy Policy (“Policy”) describes how Castle Benscoter Ventures LLC, a Delaware limited liability company, (“Company”) in connection to its mobile application “Chaser” (“Chaser” or “App”), collects, uses, and discloses information from you (individually a “User”, and collectively, “Users”), in its capacity as a data controller via a mobile application and in connection with any other consumer-facing services offered that link to or otherwise present this Policy to you (collectively, the “Services”).

Subject to its Terms of Service, Company may process information on behalf of partners/vendors (collectively “Customers”) who process such information for their own purposes, such as to provide Users with access to the events they host. Company may also process information regarding its customers’ employees in order to provide access to the Services they have contracted with Company to receive. Customers determine how and why Company processes such information, and this Policy does not address such processing. Please read this Policy carefully to understand how Company processes your information. By using the Services, you agree that you have read and understand this Policy, and that Company may collect, use, disclose, retain, and otherwise process your information as set forth in the Policy below. If you do not want Company to process your information as described in this Policy, please do not use the Services.

1. Information Company Collects

Information you provide to Company

Company may collect information that you provide when you interact with Company or use the Services, including any information you provide when you create an account, input information on the mobile app, or contact Company in any way. This information may include:

In addition, Company works with partners such as venues, event organizers, and nightlife establishments. If you attend an event of one of its partners, you hereby authorize Company and its partners to photograph you for its or its partners’ uses, including but not limited to, supporting event promotion, advertising, and/or portfolio development.

You may have the option to submit content or other information to the Services. Company and its partners may use any content you post on the Services, including any photographs, including via its partners’ social media pages and accounts and in connection with joint marketing and other promotions. Where content is displayed on or through a venue, event organizer, or other third-party establishment, their privacy notices apply to that information. Please consult their privacy policy for more information about how your information may be processed.

You agree to exercise discretion in deciding what information and content you share, upload, post, and otherwise provide via the Services. You are solely liable for the content you upload, and Company is not responsible or liable for any consequences of your decision to provide content to the Services.

Information collected automatically

By using the Services, certain information is gathered automatically to ensure the Services operate at intended, including:

Company may collect internet, device, or other electronic network activity information, as follows. When you use the Services, Company and its vendors may collect certain information about you automatically using cookies and similar technologies (together, “Cookies”). Cookies are small text files placed on your device that perform a variety of functions, including recognizing your device, remembering your preferences, enabling the Services to function, assisting with security, and improving Company’s analytics. Cookies may collect information about your device and your use of the Services, such as your IP address, device identifiers and online identifiers (such as cookie IDs and mobile advertising ID), information about your operating system (such as version), and device (such as model and manufacturer).

Information collected from other sources

Company may collect information about you from other sources, including business partners (such as venues, event producers), marketers, and publicly available sources, including social media platforms where permitted by applicable law.

Company may combine the information it collects from third parties with information that it collects from you or through your use of the Service, and likewise, Company may combine any information that it collects from you with such information.

2. How Company Uses Information

General use

Company may use the information it collects for various purposes, depending on the type of information and the Services you use, including:

Company may combine information that it collects from and about you (including automatically collected information), including information that it obtains about you from third parties, and use such combined information in accordance with this Policy.

Company may aggregate, de-identify, and/or anonymize any information collected in connection with and through the Services so that such information is not reasonably able to identify you. Company may use and disclose aggregated, de-identified, and/or anonymized information for any purpose and to any third-party, at its discretion.

Friend location sharing

The Services include a feature that allows for friend location sharing through the Chaser application. This feature is enabled only if turned on by the User and may be turned off, paused, or hidden (“ghost mode”) at any point. Friend connections through the app may also be added or removed at any time. You may also disable device location features entirely.

You control location permissions through your device settings. You can disable precise location tracking at any time; some app features may not work without these tracking permissions enabled.

Company does not sell your precise location, and it does not share it with third party venues, except as needed to confirm check-in or reward redemptions as initiated by the User.

Information shared with venues

When you check in at a venue, that venue’s operator can see limited information about your visit through Company’s venue tools. This applies only to the venue you checked into, and only to your activity at that venue. Venue operators can see:

Where Company has enabled the relevant feature, venue operators may additionally see your display name and profile photo alongside your check-in, and aggregate age-range counts for a given night (for example, “six guests aged 21–24”). Aggregate counts are shown only as group totals, are never linked to you individually, and are withheld entirely where too few guests on that night have provided the information for a total to be meaningful.

Venue operators never receive your gender, your precise location, your device identifiers, your phone number or email address, your activity at any other venue, your friends, plans, or posts, or your reward redemption codes.

Providing an age range in your profile is optional. If you leave it blank, you are never included in any venue total. Browsing venues, viewing the map, and using plans do not disclose anything to a venue; only checking in does.

Online analytics

Company and its vendors may use third-party analytic services on the Services to help understand how users engage with the Services, including Google Analytics. These parties may use Cookies to help collect, analyze, and provide Company with reports and/or data. Mobile devices often include settings to help you manage how your device collects and transmits information for advertising purposes. Modifying your mobile device settings or opting out of tailored advertising via your web browser, may have different results depending on the type of device or web browser you use and the version of your device operating system. Opting out of tailored advertising does not prevent you from seeing advertisements online; instead, the ads you see are less likely to be customized to your interests. Some opt-out mechanisms are only effective on a device-by-device basis. If you use more than one device, the effect of any opt-out mechanism may be limited to the device on which you used the mechanism.

3. Children/Minors

The Services are intended for users at least 21 years of age and are not directed to users under the age of 21. Company does not knowingly collect personal information from users under the age of 21.

4. Data Retention

Company retains personal information for the duration as needed to support the Services’ legitimate business and legal purposes, after which it will be deleted or de-identified. Aggregated or de-identified data may be retained indefinitely.

5. Data Security

Company uses reasonable administrative, technical, and organizational measures to ensure the protection of user data. Neither Company nor Chaser can guarantee absolute data security; however, users will be promptly aware should a breach put any collected data at risk.

6. Policy Changes

Company may make changes and updates to this Policy on a rolling basis. If material changes are made, Company will provide users with a notice through the Services or through other reasonable means.
